Welcome to Precision Auto Parts Group LLC. These Terms of Service (“Terms”) govern your access to and use of our website (https://precisionautopartsgroup.com) and all transactions involving the purchase of automotive parts. By requesting a quote, placing an order, submitting a deposit, or completing payment, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. BINDING EFFECT & INCORPORATION

These Terms incorporate by reference all applicable PAS policies, including but not limited to the Privacy Policy, Shipping Policy, Return & Refund Policy, and Warranty Policy.

By using our Services or completing a purchase, you expressly acknowledge and agree that:

You have reviewed and accepted all referenced policies
These Terms shall govern in the event of any inconsistency between policies
Completion of payment constitutes full and binding acceptance of all terms, regardless of whether a physical signature has been obtained
All remedies available to the customer are limited strictly to those expressly stated within these Terms and associated policies

2. PRODUCT CONDITION & VIN VERIFICATION

Inventory Condition:
Precision Auto Parts Group specializes in used OEM, reconditioned, and rebuilt automotive components. By purchasing from PAS, you acknowledge that such parts may exhibit normal wear consistent with prior use, including but not limited to surface rust, oil residue, and minor cosmetic imperfections. These characteristics are inherent to pre-owned components and do not affect functionality.

Cosmetic conditions alone shall not constitute a defect or valid ground for return, refund, or warranty claim.

VIN Verification & Fitment Responsibility:
Fitment is determined based on the Vehicle Identification Number (VIN) provided by the customer. While PAS may assist in verifying compatibility, the accuracy, completeness, and correctness of the VIN and vehicle details remain the sole responsibility of the customer.

PAS shall not be liable for incompatibility, fitment issues, configuration differences, or performance concerns resulting from inaccurate, incomplete, or omitted vehicle information. Orders placed without verified VIN confirmation are processed entirely at the customer’s risk.

3. STANDARD 30-DAY WARRANTY

Warranty Period:
Unless otherwise expressly stated in writing on the official invoice at the time of purchase, all eligible mechanical components carry a standard 30-day parts-only warranty from the date of delivery. This warranty begins strictly on the delivery date without exception.

Coverage:
This warranty is limited to internal functional defects of the supplied part and provides for repair, replacement, or refund strictly at the sole discretion of PAS. Replacement shall be the primary remedy where applicable.

Exclusions:
This warranty does not cover:

Labor or installation costs
Diagnostic fees
Towing, rental vehicle, or incidental expenses
Overheating, lubrication failure, or contamination
Improper installation, misuse, neglect, or abuse
Failure of related vehicle components
Delayed installation or improper storage after delivery
Any attached accessories (including but not limited to sensors, wiring, hoses, belts, manifolds, and electronics), which are provided for convenience only and are not covered

Warranty Conditions & Voiding:
Warranty coverage is strictly contingent upon:

Installation of the part within ten (10) calendar days from the date of delivery
Installation performed by a qualified and certified technician
Submission of installation documentation, including invoice, receipt, and applicable checklist, within ten (10) days of delivery
Proper installation procedures, including correction of the root cause of the original failure

Failure to meet any of the above conditions may result in denial or voidance of warranty coverage.

Any disassembly, modification, or unauthorized alteration of the part without prior written approval from PAS will void the warranty.

All warranty claims must be supported by certified diagnostic documentation (ASE or equivalent). Customer statements alone shall not be considered sufficient.

PAS disclaims all implied warranties, including but not limited to merchantability and fitness for a particular purpose, to the fullest extent permitted by law.

4. SMS & TEXT MESSAGING (TCR COMPLIANCE)

By providing your phone number and opting in through our website forms, you agree to the following:

Consent & Purpose: You provide express written consent to receive informational and conversational SMS/MMS messages regarding your part quotes, VIN verification, order status, and shipping updates.
Opt-In Method: Consent is obtained via an optional, un-pre-ticked checkbox on our contact and quote request forms. Consent is not a condition of purchase.
Opt-Out: You may cancel the SMS service at any time by replying STOP. A final confirmation text will be sent to you.

Data Sharing: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Frequency & Rates: Message frequency varies based on your inquiry. Message and data rates may apply.

5. SHIPPING & INSPECTION OBLIGATIONS

Inspection Requirement:
As detailed in our Shipping Policy, all shipments—particularly freight (LTL) deliveries—must be inspected thoroughly at the time of delivery and prior to signing the delivery receipt.

Acceptance & Liability Release:
Signing the delivery receipt without noting damage on the Bill of Lading (BOL) constitutes full acknowledgment that the shipment has been received in good condition.

Upon such acceptance:

The shipment is deemed delivered in satisfactory condition
Precision Auto Parts Group and the carrier are released from all liability for damage, including concealed damage
No claims for shipping damage will be accepted thereafter under any circumstances

Customers are solely responsible for ensuring proper inspection prior to acceptance.

6. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Customers agree to attempt resolution directly with PAS prior to initiating any legal action, dispute, or chargeback.

Any disputes arising from or relating to these Terms or transactions with PAS shall be resolved within the appropriate jurisdiction in the State of Texas.

Where permitted by law, the prevailing party may be entitled to recover reasonable legal fees and associated costs.

PAS shall not be liable for delays or failure in performance due to events beyond its reasonable control, including but not limited to carrier delays, supply chain disruptions, or unforeseen operational events.
